Welcome to Eastern North Carolina Designs LLC ("ENC Designs", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the website encdllc.com, as well as any services, consultations, designs, or installations we provide. By using our website, contacting us, requesting a consultation, or engaging us for a project, you agree to these Terms.

Acceptance of Terms

By accessing our website or engaging our services, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement. If you do not agree with any portion of these Terms, please do not use our website or services. Continued use constitutes acceptance.

Description of Services

Eastern North Carolina Designs LLC is a luxury outdoor living design-build firm serving coastal North Carolina. Our services include, but are not limited to:

• Custom landscape and outdoor living design
• 3D digital renderings and design visualization
• Paver patios, retaining walls, and hardscape construction
• Outdoor kitchens, fire features, and water features
• Pergolas, decks, and shade structures
• Drainage solutions and landscape lighting
• Softscape and planting installations

All project specifics, pricing, and scope are detailed in a separate written service agreement signed prior to work beginning. These Terms govern the website and general relationship; the signed agreement governs each specific project.

SMS / Text Message Terms

When you provide your phone number to Eastern North Carolina Designs LLC and opt in through our contact form, you agree to receive text messages from us. There are two types of messages you may receive:

• Transactional messages: appointment confirmations, project updates, scheduling, and billing communications related to your specific project
• Marketing messages: seasonal promotions, project showcases, and offers from ENC Designs

Both types require separate, affirmative opt-in via distinct checkboxes on our contact form. Consent is not a condition of purchasing any services or goods from us.

Message frequency: Message frequency varies. You can typically expect 1-4 messages per month, though this may increase during active project phases when we send scheduling and progress updates.

Costs: Message and data rates may apply. ENC Designs does not charge for the messages themselves, but your wireless carrier's standard message and data rates will apply.

Opt-out: You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After replying STOP, you will receive one final confirmation that you have been unsubscribed, and you will not receive additional messages unless you opt in again.

No data sharing: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of SMS information sharing are excluded from third-party data sharing.

Use of Our Website

You agree to use our website only for lawful purposes and in a manner that does not infringe on the rights of others or restrict their use of the site. Consultations and Estimates

Initial consultations are provided free of charge and are a no-obligation conversation about your property and goals. Written estimates are prepared based on the scope discussed during consultation. Estimates are valid for the period noted on the document and may be adjusted if scope changes, site conditions are different than described, or material costs fluctuate significantly before the project begins.

Project Agreements

All installed projects are governed by a separate written service agreement signed by both parties prior to any work beginning. That agreement controls project scope, schedule, payment terms, change orders, and warranty. In the event of any conflict between these Terms and a signed project agreement, the signed project agreement controls for that specific project.

Warranties

We stand behind our work. Specific warranty terms — including duration, coverage scope, and exclusions — are provided in each individual project agreement. Generally, we warrant our workmanship against defects for a defined period after substantial completion, subject to normal wear, weather events, and proper owner maintenance. Manufacturer warranties on products (pavers, equipment, lighting, etc.) pass through to the client per the manufacturer's terms.

Except as expressly stated in a signed project agreement, our services and this website are provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by North Carolina law, Eastern North Carolina Designs LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our website or services, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from services provided under a signed project agreement shall not exceed the amount paid by you under that specific agreement, unless a higher amount is required by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Eastern North Carolina Designs LLC, its members, employees, subcontractors, and affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable attorney fees) arising out of your breach of these Terms, your misuse of our website, or your violation of any law or the rights of any third party.

Our website may contain links to third-party websites that are not owned or controlled by ENC Designs. We are not responsible for the content, policies, or practices of any third-party sites. Your use of third-party sites is at your own risk, subject to their own terms and policies.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
